Required Provisions

Changes effective for health plans years beginning on or after September 23, 2010

  • Young adults are allowed stay on their parent’s plan until they turn 26 years old.

  • All new plans must cover certain preventative care for infants, children, and adolescents, without charging the deductible, a co-pay, or coinsurance.

  • The law provides a way to appeal coverage determinations and establishes an external review process.

  • Insurance companies are prohibited from establishing lifetime dollar limits on insurance coverage on essential benefits.

  • Insurance companies are prohibited from rescinding coverage due to technical mistakes on customer applications. In the past insurance companies could deny payment for services when he or she got sick due to errors made by the consumer. Coverage may only be rescinded for fraud or intentional misrepresentation of material fact.

  • Insurance companies are prohibited from denying coverage of children based on their pre-existing conditions. This law pertains to new plans and existing group plans.
