Certain subdivision developers must register with the Colorado Real Estate Commission prior to selling, leasing, transferring or negotiating to sell or lease a part of that subdivision, which is under the jurisdiction of the Commission. Individual projects are required to be under the registration of a registered subdivision developer and must be individually approved. Traditional real estate subdivisions, unless meeting the requirements outlined below, are to be registered with the municipality or county where the property is located.
The subdivision developer registration requirement applies to:
Raw Ground Subdivisions - Real property divided into twenty or more interests intended solely for residential use and offered for sale, lease, or transfer. Each of the twenty or more lots must exceed thirty-five acres;
Timeshare - A group of twenty or more time shares interests intended for residential use;
Condo Conversions - The conversion of an existing structure into a common interest community of twenty or more residential units;
Cooperative Condos - A group of twenty or more propriety leases in a cooperative housing corporation.
